These Terms of Service (“Terms”) govern your access to and use of the website operated by Annette Hale’s Indoor Comfort Systems, Inc. (“Indoor Comfort Systems,” “ICS,” “we,” “us,” or “our”), including indoorcomforthsv.com and webpages that link to these Terms (collectively, the “Website”).

By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website. These Terms apply to the Website only. Any estimate, work order, maintenance plan, financing agreement, warranty, or other service agreement may contain additional terms. If those terms conflict with these Terms regarding the purchased service, the applicable service agreement controls.

1. Eligibility and Permitted Use

You must be at least 18 years old and able to enter into a binding agreement to request or purchase services through the Website. You may use the Website only for lawful, personal, or legitimate business purposes.

2. Website Information Is Not a Service Agreement

Website content is provided for general informational purposes. Submitting a form, requesting an appointment, or receiving an automated confirmation does not create a service contract, guarantee an appointment time, guarantee availability, or obligate ICS to perform work. An appointment or service is confirmed only when we expressly accept it. Scope, price, timing, warranties, and other service terms will be stated in the applicable estimate, work order, invoice, or separate agreement.

HVAC conditions and solutions depend on an on-site evaluation. Website information is not a substitute for a professional inspection and should not be relied on as technical, safety, legal, tax, or financial advice.

3. Estimates, Pricing, Appointments, and Service Availability

• Prices, discounts, estimated savings, and availability shown on the Website may change without notice and may be subject to eligibility requirements, exclusions, taxes, equipment availability, or expiration dates.
• An estimate may be revised if an inspection reveals conditions, code requirements, equipment needs, or work outside the original scope.
• You agree to provide accurate contact, location, equipment, and service information and reasonable access to the service location.
• If you need to cancel or reschedule, please contact us as soon as reasonably possible. Any cancellation or dispatch fee will be disclosed in the applicable service agreement or when the appointment is arranged.
• Service is offered only in areas we serve and is subject to staffing, weather, equipment, site conditions, safety considerations, and other operational constraints.

4. Emergency Disclaimer

Do not use a website form for a life-threatening emergency, suspected gas leak, fire, or carbon monoxide alarm. Leave the affected area if appropriate and call 911, the fire department, your gas utility, or another appropriate emergency authority. Website forms and email are not monitored continuously.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE WEBSITE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ICS FOR CLAIMS ARISING FROM OR RELATED TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY ONLY TO WEBSITE USE AND DO NOT LIMIT LIABILITY UNDER A SEPARATE SERVICE AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ICS and its officers, employees, and agents from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Website, your violation of these Terms, or your infringement of another person’s rights.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any court proceeding arising solely from Website use must be brought in a state or federal court with jurisdiction in Madison County, Alabama, and you consent to that venue and jurisdiction. This section does not prevent either party from bringing an eligible matter in small-claims court and does not override dispute terms in a separate service or financing agreement.

16. Changes to These Terms

We may update these Terms from time to time. The “Effective date” above identifies the current version. Changes apply prospectively when posted unless a later date is stated. Your continued use of the Website after an update constitutes acceptance of the revised Terms.

17. General Terms

If a provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, or transfer of the Website or business. These Terms, together with the Privacy Policy and any terms expressly incorporated here, are the entire agreement regarding use of the Website.
